The New False Claims Act: FERA and New Frontiers in Iraq and Afghanistan

Recent months have seen two significant developments relating to the False Claims Act, both of which have particular relevance to cases brought against companies with contracts associated with the conflicts in Iraq and Aghanistan. First, in April, the Fourth Circuit ruled in the Custer Battles case that a "claim" under the False Claims Act includes those made to an entity other than the U.S. Government so long as any portion of the claim will be paid with U.S. Government funds. Second, in May, President Obama signed the Fraud Enforcement and Recovery Act ("FERA"), which included sweeping amendments to the False Claims Act. Many in the defense bar fear that FERA, by easing the "presentment" and "federal funds" requirements, could significantly expand contractor liability. With a bevy of cases pending against contractors in Iraq, and with many more surely to be filed relating to the United States' efforts in Iraq and Afghanistan, it is critical that practitioners understand precisely how these developments have changed the False Claims Act landscape. |
