Please join John Heintz, Esq. of Kelley Drye for this discussion, which will focus on two climate change-related lawsuits: Steadfast Insurance Co. v. The AES Corporation and Native Village of Kivalina, et al. v. ExxonMobil Corp., et al.

What are some possible outcomes of the Steadfast case and its effects on the insurer? We will examine three coverage issues raised in the Steadfast suit:


  • Whether the claims arise out of an "occurrence"
  • Whether the claims are barred by the "loss in progress" doctrine
  • Whether the pollution exclusion applies.
